Conveyancing
In law, conveyancing is the transfer of legal title to real property from one person to another, or the granting of an encumbrance such as a mortgage or a lien. A typical conveyancing transaction has two major phases: the exchange of contracts and completion, also called settlement, when legal title passes and equitable rights merge with the legal title.
Conveyancing
We are a Cape Town based firm of attorneys and attend to the transfer of property anywhere in South Africa.
Only qualified conveyancers may attend to the transfer of fixed properties and related transactions.
This protects the rights and interest of the public and also safeguards the integrity of the South African Land Registration System, which is universally regarded as one of the best in the world.
Essentially conveyancing is the transfer of legal title to property from one person to another. It also deals with the transfer of immovable property, the burdening of immovable property by means of mortgage bonds and the execution of various other acts.
Notarial Services
A Notary Public is an attorney who is legally empowered to witness the signing of documents, take statements from the public, and certify that the contents of an official document are indeed true and correct. A Notary is held to a higher standard of care than an attorney, in some respects.
Our Notaries Public perform a broad range of notarial services for clients, including the drafting of ante-nuptial contracts, notarial deeds of servitude and exclusive use areas. Notarial documents must be attested before the Notary Public and notarial deeds are registered at the Deeds Office where they become documents of public record.
